All home plans sold by Winstamac are protected by International Copyright Law. Reproducing these home plans, either in whole or in part, including any form of copying and/or preparation of derivative works thereof, for any reason without prior written permission, is strictly prohibited and subject to statutory damages plus attorney fees and loss of profits. All parties including designers, draftsmen, owners, builders, realtors, copy shops and blue-printers may be responsible if a copyright is violated be it to their knowledge or otherwise.

The Company retains the right to publish, sell, resell, advertise or use in any way any design, custom design, drawing, detail, image, calculation, sketch, or any other material that is produced by The Company. The above remains to be the explicit property of Winstamac at all times unless agreed otherwise in writing between Maramani LLC and the client.

CUSTOM DESIGNS

The Company will develop new custom designs based on your exact requirements in case you cannot find a plan that fits your requirements. You will receive regular updates of plans and its specifications to give you an exact picture of how the plans will function and how the building will look like. Changes can be requested up to 4 times during the sketch stage of designing the plans. Any further changes after this or after final approval of sketch design by client will be charged an additional fee at an hourly rate.

One can however have the exclusive rights to their plan as provisions are made for that.

PRIVACY POLICY

Certain information is collected from users as are necessary for provision of services and to improve overall user experience on our site. Information collected from customers and users in general are only used in this regard and we do not sell or rent user data provided to any third party.

Winstamac holds the privacy of our customers in high regard and are respected.

Without limitation of the foregoing, the plans are protected by Ghana Copyright Laws; and any use of the information contained therein beyond the time use authorized under the License, or any reproduction, publication, sale or distribution of any part of the Plans without the prior written consent of the Company, constitutes a violation copyright laws, and may subject the perpetuator(s) to prosecution and the prescribed penalties to the full extent as provided thereunder. You represent and warrant to us that you own all Intellectual Property Rights in Your Information. By submitting Your Information, you automatically grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable right and license to use Your Information in connection with the Site and otherwise in ways consistent with the privacy policy. PRICING, REFUND/EXCHANGE POLICY

Winstamac reserves the right to subject prices to change without notice. No order and pricing shall be final until confirmed by the Company.

We shall not be liable for any modification, price change, suspension or end of support for a particular service.

Payments made are not refundable after purchase have been made and file downloaded.

Products or services may have limited quantities and are subject to exchange according to our policy.

DISCLAIMER:

All home plans provided on the Site are supported by photographs, perspectives and a 3D animation and are only to be used as general guides to what the house may look like when built.

Final construction may look and appear different from dimensions provided by the Company because of changes made during the construction and rendering process.

1. Additional disclaimers and requirements.
   1. The Plans are intended to indicate design intent and basic construction detailing. It remains your responsibility to ensure that you have obtained the proper professional assistance to provide standard construction details and practices, which will result in a structurally sound and weatherproof finished product. Any use of the Plans, and/or modifications of the Plans, by you, builders or others on your behalf, is done at your own risk.
   2. The Plans do not include any plumbing, heating or air conditioning drawings due to the wide variety of local codes and climatic conditions. We recommend that you have a local electrical engineer, mechanical engineer or builder provide such of these drawings as may be required for permits and construction.

• Any foundation plan and associated details included in the Plans are intended to serve as a basic guide for a typical foundation system. This typical foundation system is not site- or location-specific. You acknowledge our recommendation that you have a local designer or licensed engineer review the Plans and provide a site-specific foundation design if found necessary.

1. The Plans provide ideas and concepts and are not intended to be complete in all respects and details. Variations in standard sizes (e.g., of windows and doors), and brands, thicknesses, types and uses of different materials can change details. Varying local codes, ordinances, regulations, foundation requirements, and the layout of electrical, mechanical, and plumbing systems may also require changes of details.
2. Names of materials and manufacturers shown on the Plans do not represent an endorsement or recommendation by Winstamac. Final selections of materials are the responsibility of you and/or your builder, including proper installation of materials, nailing, gluing, caulking, insulating, flashing, roofing, weatherproofing and many other small items and details not necessarily indicated on the Plans. Winstamac has no control or responsibility with respect to such matters.
3. The Plans do not have an architectural or engineering signature, seal and/or stamp. You agree to consult the local building official who can tell you if a review of the Plans by a licensed designer or engineer is required prior to submission of the Plans for a building permit. Because of the great differences in geography and climate in different areas, there are varying building codes, zoning requirements, ordinances, and/or building regulations. The Plans may need to be modified to comply with local requirements. In addition, you may need to obtain permits or inspections from local governments before and in the course of construction. Your right to use the Plans is conditioned on your agreement to, and you affirm that you shall: (a) consult a locally licensed designer or engineer of your choice prior to beginning construction, and (b) strictly comply with all local building codes, zoning requirements, and other applicable laws, regulations, ordinances, and requirements.

• Plans purchased for homes to be built in certain jurisdictions may require that it be redrawn by a locally registered professional; and you agree that, if applicable, you will consult a local building official or legal counsel with respect to such requirements.
• Due to the large number of Plans and price options for the Plans offered by Winstamac, data entry and other errors inevitably may occur in the text and pricing shown on this Site. The Company reserves the right to correct such errors as they are discovered, and no order and pricing with respect to that order shall be final until confirmed by the Company.

Indemnification

Provisions made available on each purchase

There are minimum requirements for each house plan that is purchased from the Company:

• A detailed dimension for the floor plan for each level.
• The whole house and/or partial cross-section(s)
• Perspective for all side of the building
• A pdf and dwg file for each house plan
